By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Robert E. Sylva, Sr. and Shirley M. Sylva to Vermont Federal Credit Union dated May 18, 2010 and recorded May 26, 2010 in Book 118, Page 288 of the Town of Richford Land Records, of which Mortgage Federal National Mortgage Association is the present owner and Vermont Federal Credit Union is the servicer;

Also by virtue of a Certificate of Non-Redemption dated September 5, 2019 and a Judgment and Decree of Foreclosure by Judicial Sale entered July 10, 2019 in a matter entitled Vermont Federal Credit Union, As Servicer for Federal National Mortgage Association v. Robert E. Sylva, Sr., et al., Docket No. 198-5-19 Frcv, and to be recorded in the Town of Highgate Land Records.

TIME AND PLACE OF PUBLIC SALE: For breach of the conditions of and for the purpose of foreclosing said Mortgage, and also for the purpose of effectuating said Judgment and Decree of Foreclosure by Judicial Sale, the property described in said Mortgage will be sold at Public Auction on October 23, 2019 at 2:00 pm at the property addresses of 52 Center Street in Richford, Vermont.

The public sale may be adjourned one or more times for a total time not exceeding 30 days, without further Court order, and without publication of a new notice of sale, by announcement of the new sale date to those present at each adjournment or by posting notice of the adjournment in a conspicuous place at the location of the sale.

PROPERTY DESCRIPTION: The property being sold is all and the same lands and premises described in said Mortgage, to wit:

Being all and the same lands and premises conveyed to Robert Sylva and Shirley M. Sylva by Warranty Deed of Dennis Martin, Jr., dated July 10, 2002 and of record in Volume 87, Pages 637-638 of Town of Richford Land Records, and being more particularly described therein as follows:

Being all and the same land and premises conveyed to Dennis Martin, Jr. by Warranty Deed of Thomas Michel dated February 15, 2000, recorded in Book 81, Pages 644-645 of the Town of Richford Land Records. Also being and meaning all and the same lands and premises conveyed to Thomas Michel by Warranty Deed of Norman Ray Heath and Joyce Heath dated October 7, 1988, and recorded in Book 61, Pages 399-400 of the Town of Richford Land Records.

A parcel of land with buildings thereon lying on the westerly side of Center Street, and more particularly described as follows:

Beginning at a point on the westerly side of Center Street, which point designates the northeasterly corner of the lot herein conveyed; thence westerly a distance of one hundred sixty-five feet (165'), more or less, to a point; thence southerly a distance of one hundred five feet (105'), more or less, to a point; thence easterly a distance of one hundred five feet (105'), more or less, to a point on the westerly side of Center Street; thence northerly a distance of one hundred five feet (105'), more or less, to the point of beginning.

Being and meaning a portion of the same land and premises conveyed to Lionel Messier (now deceased) and Theresa Messier, husband and wife, by Warranty Deed of Hattie M. Calder (widow) dated December 6, 1957 and recorded in Book 47, Page 71 of the Town of Richford Land Records.

Reference is hereby made to a Certificate of Non-Redemption [sic] from the Franklin Superior Court to Norman Ray Heath dated October 11, 1988, recorded at Book 64, Page 130 of the Town of Richford Land Records.

EXCEPT and RESERVED by Theresa Messier is a parcel of land lying southerly of, and adjacent to, the above-described parcel which reserved parcel has a frontage of 60 feet, more or less, and a depth of 165 feet, more or less, and more particularly described as follows:

Beginning at a point on the westerly side of Center Street, which point represents the northeasterly corner of the reserved lot and the southeasterly corner of the lot above conveyed; thence westerly a distance of 165 feet, to a point (which point designates the southwesterly corner of the above conveyed lot); thence southerly a distance of 60 feet, more or less, to a point; thence easterly a distance of 165 feet, more or less, to a point on the westerly side of Center Street; thence northerly a distance of 60 Feet, more or less, to the point of beginning.

Said excepted and reserved lot is all and the remaining lands conveyed to Theresa Messier.

Reference is hereby made to State of Vermont Deferral of Permit #D60866 which was converted to Land Use Permit No. EC-6-1026 dated November 19, 1984, recorded August 1, 1996 at Book 75, Pages 34-35 of the Town of Richford Land Records.

The reference to a Certificate of Non-Redemption dated October 11, 1998 above is incorrect and should reference a Certificate of Redemption from the Franklin Superior Court to Norman Ray Heath dated October 11, 1988, recorded at Book 64, Page 130 of the Town of Richford Land Records.

Reference is hereby made to the aforementioned instruments, the records thereof and the references therein contained, in further aid of this description.

The description of the property contained in the Mortgage shall control in the event of a typographical error in this publication.

TERMS OF SALE: To qualify to bid, prospective bidders must tender to the auctioneer before the sale the amount of $10,000.00 (the "Bid Qualifying Deposit") in cash, certified funds, bank check, or other primary bank obligation, unless the parties agree on some other amount. The property shall be sold to the highest bidder, and the successful bidder's Bid Qualifying Deposit shall be held as a non-refundable deposit. All other Bid Qualifying Deposits shall be returned to the unsuccessful bidders who supplied them.

The successful bidder will be required to sign a "no contingency" purchase and sale agreement at the conclusion of the auction. The sale is "AS IS, WHERE IS," subject to all liens, encumbrances, unpaid taxes, municipal assessments, and other matters which take precedence over the Mortgage. The closing shall be held, and the balance of the purchase price shall be due and payable in cash, certified funds, bank check, or other primary bank obligation, within fourteen (14) days after the sale has been confirmed by the Court, unless such date is mutually extended by the parties.

RIGHT TO REDEEM: The mortgagors are entitled to redeem the premises at any time prior to the sale by paying the full amount due under the Mortgage, including the costs and expenses of the sale.
