NOTICE OF PUBLIC SALE Pursuant to the terms and conditions of the Judgment Order, Decree of Foreclosure and Order of Public Sale in the matter of Harmon Mayo and Janet Mayo v. Douglas Eric Nelson, Judith Peach, et al, Franklin Superior Court Docket No. S 40-08 Fc filed September 15, 2009, foreclosing a certain mortgage given by Douglas Eric Nelson and Judith Peach to Harmon Mayo and Janet Mayo dated December 22, 1998 and recorded on December 22, 1998 in Book 50, Page 153 of the Land Records of the Town of Bakersfield, for breach of the conditions of the mortgage, the below described real estate will be sold at public auction at 10:00 AM on November 30, 2009 at the location of the property described in the mortgage, on knowledge and belief known and designated as having an address of 418 North Main Street, Bakersfield, Vermont. The property to be sold (the "Property") is all and the same land and premises described in said mortgage and further described as follows: Being all and the same lands and premises conveyed to Douglas Eric Nelson and Judith Peach by Warranty Deed of Harmon Mayo and Janet Mayo dated and recorded on December 22, 1998 in Book 50, Page 153 of the Land Records of the Town of Bakersfield, and being more particularly described as follows: Parcel #1: Being about one-eighth (1/8) acre of land, with the garage building located thereon, and bounded as follows, viz: on the westerly side by Main Street, so-called; on the easterly side by lands now or formerly of Earl Gates and wife; on the southerly by land now or formerly of Alcide Murcury and wife; and on the northerly side by lands now or formerly of Challice J. Start. Parcel #2: Being a lot of land containing 1.1 acres, more or less, lying easterly of, but not adjacent to, Vermont Route 108 and more particularly described as follows: "Beginning at a point which represents the northeasterly corner of Parcel #1 above, said beginning point designates the northwesterly corner of the lot conveyed hereby; thence easterly, partially along the southerly boundary of land formerly owned by Mayo and Silverfine, a distance of two hundred two feet (202'), more or less, to a corner; thence southerly a distance of two hundred forty-three feet (243'), more or less, to a corner; thence westerly a distance of two hundred nine feet (209'), more or less, to the easterly boundary of property owned now or formerly by the Bakersfield Fire Department; thence northerly along the easterly boundary of property owned by the Bakersfield Fire Department and Parcel #1 above a distance of two hundred twenty-nine feet (229') to the point of beginning. Reserved and excepted from the above conveyance is a square parcel of land measuring thirty feet (30') on each side which said parcel lies in the southwesterly corner of the described property. Said property is bounded on the northerly by lands now or formerly of Mayo-Silverfine and other lands now or formerly owned by Earl and Hyla Gates; on the westerly by Parcel #1 above and the Bakersfield Fire Department; and on the southerly and easterly by lands now or formerly of said Earl and Hyla Gates. Also conveyed hereby is all right, title and interest in and to an easement conveyed to Harmon W. and Janet L. Mayo by the Bakersfield Volunteer Fire Department, Inc., dated March 18, 1985 and recorded in Book 36, Page 463 of the Bakersfield Land Records. Also conveyed hereby is a certain right of way which is fully set froth in a deed from W.D. Strewart to F.N.D. Wells dated April 22, 1904 and recorded in Book 18, Page 7 of the Bakersfield Land Records. Reference is hereby made to the above-mentioned plat and deeds and to the deeds and references therein contained in further aid of this description. The premises shall be sold in AS IS condition with any and all faults, with no representations or warranties, express or implied, of any kind, and subject to any and all current and delinquent real estate taxes and municipal assessments, including late fees, charges, and interest, for which the highest bidder shall be fully responsible. In no event are Plaintiffs responsible for obtaining any permits, amended permits or amnesty from permits to comply with any State, Federal or municipal law, regulation or ordinance or for any other reason. Plaintiffs shall also not be responsible for making any repairs, upgrades and/or treatments to the premises. The premises shall be sold subject to any and all encumbrances or title defects and no representations or warranties will be made concerning the status of the quality of title the purchaser will receive. The Property will be sold to the highest bidder, who at the sale shall either pay cash or certified funds or produce a commitment letter from a bank or mortgage company or other lender license to do business in the State of Vermont. If at the sale Harmon Mayo and Janet Mayo, the Plaintiffs, make the highest bid, they shall be required to pay cash or certified funds only to the extent that their bid is in excess of the sums due them by the Defendants, including all of their costs of the sale in this foreclosure up to the date of the sale. If any other person or entity is the highest bidder, a Ten Thousand Dollar ($10,000.00) cash deposit at the sale shall be required or a certified check, treasurer's or cashier's check made payable to "Brown Cahill Gawne & Miller, PC, Client Trust Account" and shall pay the balance of the successful bid price within thirty (30) days of the issuance of an Order of Confirmation by the Franklin Superior Court. The successful bidder will be required to sign a purchase and sale agreement. If the successful bidder fails to complete the purchase of the Property as required by the purchase and sale agreement, the $10,000.00 deposit will be forfeited to the Plaintiffs. Any purchase or sale will take the Property "AS IS" and title will be conveyed without warranties by order of confirmation. The mortgagors, Douglas Eric Nelson and Judith Peach, are entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
